Ordinance 2001-94 Approved March 20, 2001
WHEREAS, it has been determined to be in Dothan's Best interest to revise the water conservation stages of the City of Dothan Code of Ordinance.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Dothan, Alabama as follows:
Section 1. That Chapter 102, Utilities, Article III, Water Service, Division 3, Water Conservation Plan, Sec. 102-164, and Sec. 102-165 (c) of the Code of Ordinances are hereby amended to read, as follows:
Sec. 102-164. Violations.
(a) Violations of this division by any Dothan Utilities Customer shall receive the following:
1) First Offense: Written Warning and the violator to correct the violation within 30 minutes of the warning. 2) Second Offense in same calendar year: Disconnection of Water Service(s) with a $100 fee to reestablish water service. 3) Third Offense in same calendar year: Disconnection of Water Service(s) with a $500 fee to reestablish water service. 4) Fourth Offense in same calendar year: Disconnection of Water Service(s) until the water conservation plan stage that is in effect at the time of violation has expired and a fee of $1,000 to reestablish water service.
(b) The above warnings, disconnection notices, and disconnects shall be issued and implemented by the Dothan Utilities Superintendent or his designee.
Sec. 102-165. Stages.
(c) The water conservation stages shall be as follows:
(1) Stage I, voluntary conservation. Customers or persons who use city water are requested to voluntarily limit the amount of water to the amount absolutely necessary for health, business and outdoor use.
(2) Stage II, mandatory compliance; water alert. Beginning April 1 thru October 1 each year, the following restrictions shall apply to all customers or persons who use Dothan Utilities water. Stage II restrictions may be applied to the remaining months of the year upon implementation by the city chief operating officer and after public notification.
a. Irrigation utilizing individual sprinklers from hoses or buried sprinkler systems for the purpose of watering lawns, gardens, landscaped areas, trees, shrubs and other plants is prohibited, except on designated water-use days which shall be as follows:
1. Odd-numbered street addresses will water on Tuesday, Thursday and Saturday. 2. Even -numbered street addresses will water on Monday, Wednesday and Friday. 3. No Watering will be allowed on Sunday.
b. This restriction shall not apply to commercial nurseries; however, commercial nurseries should restrict water use to that which is absolutely necessary. Also exempt from the restriction is any handheld garden hose or small handheld watering container which may be used on any day to water small areas that might need more frequent watering.
(3) Stage III, mandatory compliance; water warning. Upon implementation by the chief operation officer and after public notification, the following restrictions shall be imposed in place of Stage II restrictions (until further notice) to all Dothan Utilities water customers or persons who use Dothan Utilities water:
a. Irrigation utilizing individual sprinklers from hoses or buried sprinkler systems for the purpose of watering lawns, gardens, landscaped areas, trees, shrubs and other plants is prohibited, except on designated water-use days which shall be as follows:

Users of water at street addresses containing odd numbers will water on Tuesday and Saturday.

Users of water at street addresses containing even numbers will water on Monday and Friday.
The intent of this action is to allow each customer to water two times each week, either Tuesday and Saturday or Thursday and Sunday. On the Tuesday/Saturday and Thursday/Sunday watering days, no watering may be done between the hours of 5 p.m. - 9 p.m. Handheld garden hoses or small handheld watering containers may be used on any day, except during the hours of 5 p.m. - 9 p.m.
b. Washing of private vehicles is prohibited, except on the Tuesday/ Saturday and Thursday/Sunday odd-even basis. No private vehicles may be washed between the hours of 5 p.m. - 9 p.m. Commercial car washes and service stations are exempt from this restriction. c. Swimming pools will be filled only on Tuesday/Saturday and Thursday/ Sunday on the odd/even basis. There shall be no filling between the hours of 5 p.m. - 9 p.m. d. Washing of sidewalks, streets, driveways, parking areas, tennis courts, patios or other paved areas is absolutely prohibited, except by the street department and the fire department to alleviate health or fire hazard. e. Taking water from a fire hydrant is prohibited, unless the person taking the water from the fire hydrant has a permit from the water department for an expressed purpose and the date that the hydrant may be used signed by an authorized utility representative. The water department, street department, and fire department are exempt from this condition in order to properly maintain the water system and provide for public health and safety. f. The Stage III restriction does not apply to commercial nurseries. However, commercial nurseries should restrict water use to what is absolutely necessary.
(4) Stage IV, mandatory compliance; water emergency. Upon implementation by the chief operating officer and after public notification, the following restrictions shall be imposed in place of Stage II or Stage III restrictions (until further notice) to all Dothan Utilities water customers or persons who use Dothan Utilities water: during Stage IV, no outside irrigation utilizing individual sprinklers from hoses or buried sprinkler systems for the purpose of watering lawns, gardens, landscaped areas, trees, shrubs and other plants is permitted. Also prohibited are the following:
a. The washing of private vehicles is prohibited except at commercial car washes or service stations. b. The use of water from fire hydrants for any reason, other than use by the water department, street department and fire department to maintain the water system and quality, is prohibited. c. The washing of sidewalks, streets, driveways, parking areas, tennis courts, patios or other paved areas is absolutely prohibited, except by the public works department and the fire department to alleviate health or fire hazard. d. The filling of swimming pools is prohibited during the water emergency.
Section 2. After publication as required by law, this ordinance shall become effective immediately.

b. This restriction shall not apply to commercial nurseries; however, commercial nurseries should restrict water use to that which is absolutely necessary. Also exempt from the restriction is any handheld garden hose with any cut-off/nozzle at end of hose or small handheld watering container which may be used on any day to water small areas that might need more frequent watering. Anyone on any day can use a hose with cutoff/nozzle at end of hose to wash a car or house.
(3) Stage III, mandatory compliance; water warning. Upon implementation by the chief operating officer and after public notification, the following restrictions shall be imposed in place of Stage II restrictions (until further notice) to all Dothan Utilities water customers or persons who us Dothan Utilities water:
a. Irrigation utilizing individual sprinklers from hoses or buried sprinkler systems for the purpose of watering lawns, gardens, landscaped areas, trees, shrubs and other plants is prohibited, except on designated water-use days which shall be as follows:
1. Users of water at street addresses containing odd numbers will water on Tuesday and Saturday. 2. Users of water at street addresses containing even numbers will water on Sunday and Wednesday. 3. No watering shall be allowed on Monday, Thursday and Friday.

Upon implementation by the chief operating officer and after public notification, the following restrictions shall be imposed in place of Stage II or Stage III restrictions (until further notice) to all Dothan Utilities water customers or persons who use Dothan Utilities water: during stage IV, no outside irrigation utilizing individual sprinkler systems from hoses or buried sprinkler systems for the purpose of watering lawns, gardens, landscaped areas, trees, shrubs and other plants is permitted. Also prohibited are the following:
a. The washing of private vehicles is prohibited except at commercial car washes or service stations. b.
